These Terms of Service govern your use of bentrod.us and any purchase you make from BenTrod. By using the site or placing an order, you agree to them.

1. General Conditions

  • You must be at least 18 years old, or have the consent of a parent or guardian, to place an order.
  • We may refuse service to anyone, for any lawful reason, at any time.
  • We may modify or discontinue any part of the store without notice.

2. Products & Pricing

  • All prices are in U.S. dollars and exclude applicable sales tax, which is calculated at checkout.
  • Prices and availability may change without notice.
  • Product images are representative. Blank colour, thread wraps, and finish can vary slightly between production runs.
  • Stated rod actions, powers, line ratings, and reel specifications are the manufacturer's figures.
  • We reserve the right to limit quantities on any product.

3. Accuracy of Information

We work to keep product descriptions, specifications, and pricing accurate, but errors happen. If an item is listed at an incorrect price or with an incorrect specification, we reserve the right to cancel any order placed for it, even after the order is confirmed and payment taken. In that case we will notify you and issue a full refund.

4. Orders & Payment

  • Placing an order is an offer to buy. Our confirmation email acknowledges receipt; the contract is formed when we ship.
  • Payment is taken at the time of ordering.
  • We may cancel an order where we suspect fraud, where an item is out of stock, or where we cannot lawfully ship it to your destination.

5. Account Responsibilities

If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Tell us immediately if you suspect unauthorised use.

6. Intellectual Property

All content on this site — text, layout, graphics, photographs, and the BenTrod name and logo — is owned by BenTrod or its licensors and is protected by intellectual property law. You may not copy, reproduce, or use it commercially without our written permission. Manufacturer brand names, logos, and product images remain the property of their respective owners and are used to identify the products we sell.

7. Prohibited Uses

You may not use this site to:

  • Break any law or regulation.
  • Infringe anyone's intellectual property rights.
  • Transmit malware, or attempt to probe, scan, or breach our security.
  • Scrape or harvest data by automated means without permission.
  • Submit false, misleading, or fraudulent information.
  • Harass, abuse, or defame others, including in product reviews.

8. Warranty

Rods, reels, and other equipment are covered by the warranty offered by their manufacturer. Terms, duration, and coverage vary by brand and model — check the documentation supplied with your product. We will help you file a claim; see Contact for what to send.

Manufacturer warranties typically cover defects in materials and workmanship. They typically do not cover:

  • Normal wear, including guide inserts, drag washers, bail springs, and handle grips.
  • Damage from high-sticking a rod, or from lifting a fish vertically by the rod.
  • Transport and storage damage, including doors, hatches, tailgates, and ceiling fans.
  • Use beyond the stated line or lure rating.
  • Saltwater corrosion where the product was not rinsed after use.
  • Products that have been modified, repaired by a third party, or bought second-hand.

Except as stated above, products are provided "as is" without further warranty of any kind, to the fullest extent permitted by law.

9. Fishing Regulations & Safe Use

You are responsible for holding any licence or permit required where you fish, and for confirming that the tackle you buy from us is legal to use on the water you intend to fish. Rules on hook types, line class, weight materials, and species vary widely between states and countries and change from season to season.

Fishing tackle contains sharp hooks and stores energy under load. Use it with appropriate care and supervise children around it. We are not responsible for injury resulting from misuse.

10. Limitation of Liability

To the fullest extent permitted by law, BenTrod is not liable for any indirect, incidental, special, or consequential damages arising out of your use of the site or products purchased from it, including lost fishing time, missed tournaments, travel costs, or lost profit. Our total liability for any claim is limited to the amount you paid for the product concerned.

11. Indemnification

You agree to indemnify and hold harmless BenTrod and its officers, employees, and suppliers from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

12. Third-Party Links

The site may link to third-party websites we don't control. We're not responsible for their content, products, or privacy practices. Review their terms before using them.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Bexar County, Texas.

14. Changes to Terms

We may update these Terms at any time. The current version is always posted on this page, and continuing to use the site after a change means you accept it.

15. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions stay in full force.
